2/25/2008 – Mitch Frost and Jack Young Win Summary Judgment in Alleged Toxic Tort/Mold Exposure Case
On February 25, 2008, Calhoun County Circuit Court Judge Brian P. Howell granted summary judgment to Baggette Construction, Inc. in two related cases in which the plaintiffs alleged the defendants negligently and wantonly renovated an academic building on the campus of Jacksonville State University, causing inadequate ventilation and air exchange within the building. Mr. Frost and Mr. Young presented evidence confirming any alleged exposure occurred outside the period of prescription as set forth in Ala. Code (1975) § 6-5-220 et seq. The Court was further persuaded that the alleged toxins did not constitute a continuous tort.
