In the October 2008 edition of the Journal - the Alabama Defense Lawyers Association's biannual legal periodical, Ferguson, Frost and Dodson attorney Bradley L. Hendrix published an article entitled "Overcoming Default".
Defendants facing default judgment are right to be concerned. Default judgment is a serious, if not the most serious, sanction a court can enter against a defendant for failing to follow its rules. However, even if default judgment is entered, all is not lost. Mr. Hendrix's article examines the procedures and methods for challenging an entry of default judgment, so that a case can be decided on its merits, rather than on a technicality.
