11/24/2008 – Chris Miller Obtains Summary Judgment in Premises Liability Case

On November 24, 2008, Jefferson County Circuit Court Judge Robert Vance granted summary judgment in favor of Sailormen, Inc. d/b/a Popeye’s Chicken regarding claims of negligence and wantonness. A customer of Popeye’s Chicken allegedly injured himself while exiting the restaurant. The plaintiff alleged Popeye’s Chicken was negligent or wanton in its construction and maintenance of the premises and surrounding structures and failed to warn invitees of the danger. Following discovery, Sailormen, Inc., by and through counsel Chris Miller, petitioned for summary judgment. Mr. Miller demonstrated the plaintiff’s evidence was insufficient to create an issue for trial and amounted to nothing more than speculation, conjecture, or guesswork. Moreover, Mr. Miller established the comprehensive policies and procedures utilized by his client to maintain the premises offered a reasonably safe environment for its customers. The Court agreed and granted Sailormen, Inc.’s motion on all counts asserted.
