Mitch Frost and Tanya Dugas win summary judgment in a personal injury claim arising out of the renovation of Bryant Denny Stadium. The plaintiff claimed he was injured when a piece of lumber left in the concourse area fell off a ledge and landed on his legs. The plaintiff filed suit against Brice Building Construction, Inc., the contract manager for the renovation project, and also named both a general contractor and cleaning service as defendants. The plaintiff claimed the piece of lumber was left in the concourse by one of the contractors and Brice, as contract manager, failed to ensure the work area was cleaned prior to the stadium being opened to the public. Mitch Frost and Tanya Dugas represented Brice and demonstrated the plaintiff lacked sufficient evidence to establish Brice had control over the area in which the plaintiff was injured and provided the Court with evidence there were other contractors on site who were not under Brice’s supervision that were more likely to be responsible for the discarded lumber. The court granted summary judgment in Brice’s favor due to the plaintiff’s lack of substantial evidence.
