7/15/2009 Mitch Frost and Mike Gregory win summary judgment in a personal injury claim arising from an electrocution and fall from a ladder during renovations at Perimeter Park Building II.
The plaintiff claimed he was injured when he came into contact with a live wire while working in the drop-down ceiling at Perimeter Park Building II. Plaintiff suffered a multi-level disc herniation resulting in a surgical fusion of levels T-11 to L3. The area where the work was performed was previously serviced by various contractors and electricians. Mitch Frost and Mike Gregory represented Marathon Electrical and successfully established the plaintiff failed to present substantial evidence Marathon Electrical was responsible for leaving the alleged hazardous condition in the drop-down ceiling. The trial court granted summary judgment in favor of Marathon Electrical.
