8/10/2009 - Jack Young and Neal Moore Win Defense Verdict
On August 7, 2009, Neal Moore and Jack Young obtained a defense verdict in favor of IBM in an automobile negligence and wantonness case in Jefferson County, Alabama. The plaintiff was involved in a rear-end accident with an IBM driver. He subsequently complained of low back pain and was diagnosed with a herniated disc. His complaints did not improve following a micro-discetomy and he was ultimately diagnosed with failed back syndrome and deemed totally disabled for social security purposes. Mr. Moore and Mr. Young argued the plaintiff had failed to prove the defendant was negligent in causing the accident and, further, that the plaintiff had failed to demonstrate his injuries were proximately caused by the event.
