11/9/2009 - Neal Moore and Patrick Franklin Obtain Summary Judgment

November 2009: Dale County Circuit Judge P.B. McLaughlin granted summary judgment in favor Mr. Moore and Mr. Franklin’s client in an outrage, conversion and wantonness case. A local car dealership was accused of wrongfully assisting or allowing the repossession of the plaintiff’s vehicle. Following depositions, Mr. Moore and Mr. Franklin persuaded the court that the duties and obligations claimed by the plaintiff simply did not exist. Moreover, the dealership could not be responsible for the unpredictable criminal acts of third parties.
