
8/8/2006 - Summary Judgment Granted in Hit and Run
On August 8, 2003, the Plaintiff was traveling east on Highway 72 in Madison County, Alabama, when a moving truck crossed the westbound lanes of Highway 72 and drove into the eastbound lanes in which the Plaintiff was driving. The Plaintiff swerved to miss the truck, and, in doing so, he caused his truck to flip. The moving truck left the scene of the accident. The Plaintiff claims the moving truck was a North American Van Lines truck. He filed suit against Alabama Truck Lines, Inc., which happens to be the local agent for North American Van Lines. In our summary judgment motion, we argued that the Plaintiff failed to provide any evidence that a truck from Alabama Truck Lines caused the accident.
