10/26/2006 - Defense Verdict For O'Charley's
On July 1, 2002, the Plaintiff fell while exiting an O'Charley's restaurant in Fultondale, Alabama. She immediately sought medical treatment and was unable to bear weight on her left leg in the weeks that followed. In her complaint she alleged permanent injury to her ankle ultimately requiring surgery. In addition, she had just accepted a new job but was unable to meet the conditions of her employment due to her injury. She filed suit for negligence and wantonness claiming damages for medical bills, lost wages, pain and suffering, and punitive damages. Neal Moore, on behalf of O'Charley's, presented evidence that the restaurant maintained its premises in a safe condition and breached no legally recognized duty owed to the Plaintiff. Mr. Moore also presented evidence that her damages were not believable and the extent of her injury incredible. A verdict was returned in favor of O'Charley's on all counts on October 16, 2006.
